Notice of Refusal (Preavviso di Diniego): What Should You Do?

Blog article

You applied for Italian citizenship or a residence permit, but you received a “notice of refusal” (preavviso di diniego).

What is it, and what should you do?

The notice of refusal (under Article 10-bis of Law no. 241/1990) is the letter in which the authorities tell the applicant the reasons that stand in the way of granting the citizenship or residence permit application, depending on the request.

It is sent by registered post with return receipt (raccomandata A/R) to the residence address you gave.

Examples of issues that can block an application include missing documents, insufficient income, problems with accommodation and criminal records.

The notice of refusal is an intermediate step in the procedure, not the rejection of the application: within ten days of receiving it, you can file a written response (memoria difensiva) aimed at changing the authorities' view.

This response is therefore particularly important, because it lets you correct and/or complete your application and avoid a final rejection.

Precisely because it can be decisive, it is wise to have a lawyer prepare it as well and as fully as possible.
